In consideration of participation in this Shore Thing event (“Event”) organized by Riverlife, a Pennsylvania Nonprofit Corporation, and the sponsors and partners, their agents, owners, officers, volunteers, participants, employees, and all other persons or entities acting in any capacity related to the Event (collectively “Riverlife”), I hereby enter into this Waiver (“Waiver”) and agree to the following on behalf of myself, my children, my parents, my heirs, assigns, personal representative and estate:
- That participation in this activity is purely voluntary and that I have no medical or physical conditions which could interfere with my safety in this activity, or else I am willing to assume – and bear the costs of – all risks that may be created, directly or indirectly, by any such condition.
- That I understand that participating in the Event entails known and unanticipated risks which could result in physical or emotional injury, sickness, paralysis, death, or damage to myself, to property, or to third parties. I understand that such risks simply cannot be eliminated without jeopardizing the essential qualities of participating in the Event and accept and assume all of the risks existing in this participation.
- That any Youth (under 18) that I have registered in this Event must be in the company of a parent or guardian at all times.
- That Riverlife may use any photos, videos, or likeness captured by event photographers to publicize Riverlife or the Event.
- That I have adequate insurance to cover any injury or damage I may cause or suffer while participating in the Event, or else I agree to bear the costs of such injury or damage.
I voluntarily agree to all of foregoing and accept sole responsibility for any injury to myself or others (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I may experience or incur in connection with my participation in the Event (“Claims”). I hereby release, covenant not to sue, discharge, and hold harmless Riverlife of and from the Claims, including all liabilities, claims, lawsuits, judgments, losses, actions, damages, costs or expenses of any kind arising out of or relating to the Event. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of Riverlife. This Waiver will bind and be enforceable against me and all of my personal representatives. I agree that this Waiver should be enforceable to the fullest extent of the law, and if any portion is held invalid, the remainder should continue in full legal force and effect.
Furthermore, I agree that any Claims related to this Waiver or participation in the Event shall be settled in the courts located in Allegheny County, Pennsylvania, and should Riverlife or anyone acting on their behalf, be required to incur attorney’s fees and costs to enforce this Waiver, I agree to indemnify and hold them harmless for all such fees and costs.
By registering for the Event, I acknowledge that I have had sufficient opportunity to read this Waiver; have read and understood it; and that I agree to be bound by its terms.
